FIR against Directors of Atulaya Healthcare for committing forgery

Chandigarh: An FIR has been registered against Pankaj Kumar Kansil and Anuj Gupta, both Directors of Atulaya Healthcare Pvt. Ltd, a leading player in the Tricity's health sector, which has recently tied up with the TATA Group, at Sector 11 Police Station for allegedly committing acts of fraud. The case has been registered against the duo on the complaint of Vinod Kumar Singla under Sections 420, 467, 468, and 471 of the Indian Penal Code (IPC) read with Section 120-B of the IPC. Kumar's complaint to SSP, Chandigarh was investigated by DSP Central for three months and a case was lodged after taking the DA legal's opinion.


Talking to media persons here, complainant Vinod Kumar Singla said that his signatures have been forged on various documents which have been fabricated in order to siphon off funds by the duo by breaching a Medical Clinic Services Agreement between M/s Rameshwara Hospitals Pvt Ltd, of which Singla is a Director, and Atulaya Healthcare Pvt. Ltd.

The complainant Vinod Kumar Singla is the owner of H. No.11, Sector 11- A, and had started a business providing medical clinical services in pursuance of a medical clinical services agreement dated 04.11.2015 with Atulaya Healthcare Pvt. Ltd at the premises owned by him. But the accused Pankaj Kumar Kansil and Anuj Gupta who are Directors of Atulaya Healthcare Pvt. Ltd defrauded the complainant of crores of rupees by committing forgery.

“This has been done to retain my property independently, by projecting possession on the basis of a fabricated rent agreement despite the accused persons as Directors of Atulaya Healthcare Pvt. Ltd. providing services for and on behalf of M/s Rameshwara Hospitals Pvt. Ltd., under a Medical Clinic Services Agreement. The modus operandi adopted was aimed at pocketing all funds which were to be collected on behalf of M/s Rameshwara Hospitals by Atulya,” said Singla.

In order to claim independent possession of the said property and defraud M/s Rameshwara Hospitals of business gains, a malicious conspiracy was hatched by the duo. The two accused who are also Directors of another company M/s Steadfast Healthcare Pvt. Ltd., forged a rent agreement dated 23.04.2019, allegedly executed by the complainant for House No.11. Sector 11-A, Chandigarh, shows that the said house has been rented out to the said company at a monthly rent of Rs 5,000 commencing from 01.04.2019.

In order to support the said rent agreement, the above-mentioned accused further forged a cash receipt dated 01.04.2019 allegedly issued and signed by the complainant. Then in order to establish that they were running a business in the name and style of Steadfast Healthcare Pvt. Ltd., the above-mentioned accused even prepared a letter dated 23.04.2019 addressed to the Registrar of Companies, Chandigarh, purportedly executed by the complainant, giving a ‘No Objection’ for the registered office activity and address of the company M/s Steadfast Healthcare Pvt. Ltd.

It shall be pertinent to mention here that none of these documents including the Rent Agreement, the Rent Receipt dated 01.04.2019, and the letter to the Registrar of Companies bears the signatures of the complainant. The signatures of the complainant on all these documents are forged and fabricated. In order to further cheat the complainant and establish that the company of the accused, namely, M/s Steadfast Healthcare Pvt. Ltd. was running from House No.11, Sector 11-A, Chandigarh, the accused persons submitted a Notice Of Change of Situation of Registered Office in Form with the Registrar of Companies, Chandigarh.
